B. Schmeichel advised this meeting is called for the purpose of discussing the
October 29, 2009, letter from Attorney Gallo regarding stormwater fees for Michels quarries in the Town and to get legal counsel.

N. VandeHey advised his draft letter of October 20 to Mr. Stevenson at the DNR has not been sent. It is awaiting comments in writing from Dave Mellum at Michels and a joint meeting between Michels and the Town. Mr. Mellum has expressed concern that the letter is not forceful enough.

Regarding stormwater charges for 2009 property tax bills, Attorney St. Peter advised the Town not to change the status quo at this time and to follow the same procedure as we did last year.

Attorney St. Peter requested copies of all documents listed in Attorney Gallo’s “timeline” attached to the October 29 letter. The clerk will be asked to provide this information to him.

If the Town does not pursue this with the DNR, then we will deal with Michels on a direct basis. Attorney St. Peter was given authorization to discuss with Mr. Gallo Michels’ willingness to fund litigation/lawsuit with the DNR regarding this matter.

N. VandeHey is asked to provide the Town cost information of 40% reduction if we pull the Michels load, i.e., what is the Town’s cost without Michels.

B. Schmeichel queried how this affects our other industrial permitted sites. J. St. Peter counseled we can move the charge around anyway we want, but we need to be careful because others will want the same thing. N. VandeHey advised industrial permits may not be there from year to year, the DNR keeps changing the rules, and he could re-do the swales information and we would do better than originally reported.

Next steps:

• J. St. Peter will talk to Attorney Gallo and get back to us.
• Nick will be sure Dave Mellum has reviewed the DNR draft letter, responds to us, and sets up a meeting between Michels, McMahon and the Town.
• Legal advice is not to create a credit policy at this time and apply the charges town-wide as we did last year. However, we can work on a formal appeal application form.
• Communications are to be funneled through N. VandeHey or J. St. Peter. Robin Coburn, Town Clerk, is the Town contact.
