STORM WATER UTILITY DISTRICT MEETING

May 13, 2010, 1:30 pm

In attendance: Jan DeKeyser, Glenn Winkler, Bob Schmeichel, Dave Dexter, and Geoff Hibner
Also in attendance: Nick VandeHey

1. Minutes of May 4th meeting – Supervisor Winker moved to approve the minutes. Supervisor Dexter seconded. The minutes were approved with changes as suggested by Supervisor Hibner: 5/0.
2. Discussion/Action
a. MS4 Map Updates – Maps need to be reviewed, updated, and forwarded to Nick. Supervisor DeKeyser and Robin will review the documentation and advise Nick of any map changes.
b. Storm Water Impact Fees – Money generated for MS4 storm water work does not need to be from an "impact fee" per se. Inclusion in a developer’s agreement is also an alternative. The Town needs to set a price per acre or per lot for the watershed area a pond services so that we are ready if someone’s lot flows into the pond and they want to claim credit for the pond. Nick will calculate a price (capital and operation/maintenance costs). Supervisors DeKeyser and Hibner will draft an agreement for the Herziger Pond Watershed User Fee. We need to keep in mind situations where property owners have been paying into the Storm Water Utility for undeveloped land, then develop that same land. Other situations that need consideration…developments that currently have ponds and are paying into the Utility…who is responsible for upkeep on this pond if the Town does or does not take over maintenance of the pond?
c. Parking Control Ordinance for Street Sweeping – A portion of the Town has curb and gutters and should have an ordinance for no parking when sweeping occurs. This type of ordinance assists the Town’s water quality credit. The ordinance needs to specify sweeping frequency – optimal frequency would be twice per month. Robin will give Nick the format and chapter/section for the ordinance and he will provide a draft.
i. Long Term Maintenance Agreements – The Town cannot take credit for the ponds built by private developers unless the Town has maintenance control. This documentation could be in the original zoning plat plans, if the Town already has control. Nick will check with Land and Water to determine what is currently in place. The pond must be an engineered wet pond. Whoever has maintenance responsibility for the pond needs to have a sediment manager to document the maintenance requirements. Future question: If the homeowners associations do enter into agreements with the Town and the Town can take credit, would the homeowners be given credit on their storm water charge in subdivisions such as Sunset Terrace and White Tail


d. Storm Water Quality Management Plan – This is 40% computer modeling with our plan. Nick will pull the Michels site out of the model, lowering our load and may reduce the "positive" effects as well. Note: On Map 15, the green shows areas included in the model. Some farm fields in green are not included in the model. All parcels in the Town are included in the Storm Water Utility Charge.
i. Update for DNR Grass Swale Guidance – Nick will update
ii. Update for DNR Internally Drained Guidance
iii. WPDES Industrial Permits – From a modeling perspective, we had a choice of including or excluding industrial permitted sites. Figures 15 (all included); Figure 16 (some sites excluded); and figure 17 (more sites excluded). The Board unanimously agreed to keep the industrial permitted sites in the model.
e. Site Investigation/Preliminary Design for BMPs
i. CTH O Pond – Nick will re-evaluate the size of the pond needed to get the Town to the TSS goal. One objective is to place the pond in an area that does not need a pump. We may need to pay more for the property, but will save approximately $100,000 if we don’t need a pump. Next steps: Chairman Schmeichel will begin to talk to property owners, and will include Nick. It appears that the best site would be “North side of O”.
ii. Grass swale infiltration rates – Not worth the effort if we go forward with the O pond. Wait to evaluate.
iii. Disconnect impervious surfaces – Inventory all homes to see which roofs are hard piped versus draining into the grass. If roofs are drained into the grass, then they don’t need to be included into the model. Draining to the grass is advantageous to the model. We will wait on this option.
f. Public Education Opportunities. This exercise is to continue as we are currently doing.

3. Old Business
a. DNR letter dated December 21, 2009 – Nick will reply to the DNR tomorrow.
b. Nick reported that the draft of NR 151 will be going to the DNR will not include a cap on spending.

6. Adjourn – Supervisor Dexter moved to adjourn the meeting. Supervisor Hibner seconded. Motion carried. The meeting adjourned at 4:10 pm
