TOWN OF NEENAH
STORM WATER UTILITY DISTRICT MEETING
March 22, 2010, immediately following the Town Board meeting
Municipal Building

The meeting was called to order at 9:12pm
1. Supervisor Winkler moved to approve the minutes from March 8. Supervisor Hibner seconded. The motion carried: 5/0.
2. Discussion/Action
a. McMahon Agreement to obtain NR 216 Municipal Separate Storm Sewer System (MS4) Permit – The Town received a grant of $32,000 for planning. The grant was submitted in April 2009. The agreement proposal mimics the grant. The proposal is fluid but there are specific tasks that must be accomplished. Cost share: $25,872 (Town)/32,928 (DNR) which is 56% of $58,800. The Town will need a plan to reach the 40% TSS reduction by 2013. This grant money has an expiration date of December 31, 2011. Supervisor Hibner moved to approve the agreement and have Chairman Schmeichel sign on behalf of the Town. Supervisor DeKeyser seconded. The motion carried: 5/0. The kick-off meeting will determine the appropriate next steps. The meeting is scheduled for May 4th, 1:30pm at the Town Hall.
b. Herziger Pond change orders – Ben met with Radtke to review questions and concerns. Radtke has not agreed to modify their change orders. There will be another meeting scheduled with Radtke. Schmeichel, Ed DeKeyser and Glenn Winkler will attend for the Town. Supervisor Hibner moved to authorize Schmeichel to approve the change orders up to $10,000. The negotiations should not be accomplished until an agreement is made concerning the new rock removal issue. Supervisor Dexter seconded. The motion carried: 5/0
c. MS4 Annual Report – This report serves as the permit renewal application. Supervisor Dexter moved to approve the MS4 Annual Report and have Chairman Schmeichel sign for the Stormwater Utility District. Supervisor Winkler seconded. The motion carried: 5/0
3. Old Business
a. DNR letter update – A response was received from the DNR stating the quarry and its associated load cannot be included in the analysis. Industrial permitted sites to meet the 40% TSS reduction can be used. The exception to this is industrial permitted quarries. Nick shared that Town of Menasha and City of Oshkosh are providing credits to quarries. Supervisor Dexter shared that there is a proposal to cap the spending required by municipalities in NR 151.

5. Future Meeting Topics
a. Storm water charge appeals – Supervisor Dexter and Chairman Schmeichel will make site visits before April 5th.
6. Adjourn – Supervisor Winkler moved to adjourn the meeting. Supervisor Hibner seconded. The meeting was adjourned at 10:35pm.
