July 8, 2009 Town Board Codification Workshop Minutes
TOWN OF NEENAH SPECIAL BOARD MEETING
Wednesday, July 8, 2009

Present: Jan DeKeyser, Geoff Hibner, Glenn Winkler, Dave Dexter, Bob Schmeichel
Absent: None
Also Present: None
For the purpose of working on the Town’s Codification project, the Board reviewed minutes of
its previous six meetings to evaluate responsibilities on work remaining to be done before the Public Hearing. It was decided to have one list of topics and subsequent conclusions shown with responsibility assigned in parentheses for those items that need more work. This list follows:
1. Citation Form (Clerk)
2. Fines/penalties need to cover costs (Board)
3. Establish notification procedure for adopting the Code including Public Hearing requirements, and procedure for future amendments (Clerk)
4. Decision on joining another Municipal Court, having our own, or using the Circuit Court (Board)
5. How do we address residency occurring in a mobile RV parked on someone’s property (Schmeichel).
6. Include a Town Fee Schedule (Clerk)
7. The 7 mile-per-hour wind factor, as measured at the Appleton airport, will not be used as criteria for burning in the Town.
8. Where do we address "temporary" storage units, if they are not included in the re-write of Winnebago County’s Zoning Ordinance (Schmeichel).
9. The Finance chapter adequately covers our Town needs and Wisconsin Statutes will be used for anything further that may come up.
10. Chapter 3 – Add: The Town Board will constitute the Town’s Emergency Management Committee.
11. Chapter 4 – The speed limits and stop signs will be as posted. We will not do field verification of parking, stopping and standing signs.
12. Chapter 6 – Accuracy of sections on Jurisdiction and Combining Lots needs to be done (Schmeichel).
13. Chapter 6 – Street Design Standards needs to be consistent with the new standards document; therefore, the Code will be changed to refer to the Standards document as revised from time to time.
14. Chapter 6 – Confirm all other sections of this chapter are current and not in conflict with any action taken by the Board since the Ordinance was adopted (Winkler).
15. Chapter 6 – Add an inspection fee to the fee schedule (Clerk).
16. Chapter 6 – Add a line stating that additional fees may be charged by other entities, i.e., Winnebago County, Sanitary District, etc. (DeKeyser).
17. Chapter 7 – Definition of “populous area” under 7.01 (2) (b) needs to be checked; and para. (3) (b) needs to be verified in view of the recent Wisconsin Attorney General’s opinion on carrying guns (DeKeyser).

18. Chapter 9 – Fees need to be verified that we are consistent with the required ranges (Clerk).
19. Chapter 9 – Paragraph 9.03 is deleted.
20. Chapter 9 – Paragraph 9.05. Verification required (Clerk).
21. Chapter 9 – Paragraph 9.06. Check with Attorney St. Peter on adding Cemetery and Burial Site wording ( DeKeyser).
22. Chapter 12 – Needs review by Gary Klinka (DeKeyser).
23. Chapter 12 – Need to determine who is the official keeper of building permit records. Is it the Inspector or the Town Clerk? Has the Board delegated it to the Inspector? (Clerk).
24. Chapter 12 – Need to clarify who sets the grade on foundations and include it (Schmeichel).
25. Set up meeting with Building Inspector as indicated in 6/15/09 meeting minutes (DeKeyser).
26. Chapter 13 – Needs review by Road Supervisor, particularly section 13.05 (DeKeyser).
27. Edit disk, re-type as appropriate, and add ordinances adopted since the codification project started in the format consistent with the new Code (Clerk)
28. Final Review and proof-reading (Board and Clerk).
The clerk will be compensated at her hourly rate for extra time necessitated on her part to get this Codification project work done and adopted.
Meeting adjourned by consensus at 8:50 PM. Next Codification meeting is scheduled for Tuesday, August 4, 2009, 1 PM, at the Town Hall.
