STORMWATER UTILITY DISTRICT MEETING MINUTES
January 27, 2010 at 1:00pm
Municipal Building

In attendance: Jan DeKeyser, Glenn Winkler, Bob Schmeichel, and Dave Dexter
Absent: Geoff Hibner

Chairman Schmeichel called the meeting to order 1:05pm
1. Discussion/Action –
a. Approve application for Stewardship Grant. A motion was made by Jan DeKeyser to approve having McMahon complete the required application on behalf of the Stormwater Utility District for retroactive Stewardship Grant money for the purchase of the Herziger property. Glenn Winkler seconded. The motion passed: 4/0.
b. Review appeals of Stormwater Utility charge by Town of Neenah property owners.
David Dexter stated that industrial permit is very different than the municipal stormwater permit. As long as the DNR doesn’t give the Town credit for the industrial site remedial action, the Town can’t give these sites credit. He further suggested that there would only be two circumstances for giving a credit: (1) Unbuildable lots with nothing on it. (2) Property with remedial action taken to improve storm water quality that the DNR recognizes. The ordinance has a provision to create a credit policy or not. Some municipalities have a credit policy only for small unimproved lots of a specific size, perhaps less than 40 by 40. Any storm water charge in the past would not be eligible. Supervisor DeKeyser prefers to follow the ordinance to the letter.
i. Napuck – Pete Gehrke stated that he has a permit through the DNR and all his Stormwater is discharged into the city of Neenah; therefore he does not believe that Napuck should be required to pay the Stormwater fee. Napuck also has a Stormwater retention area on site. His DNR permit states that his property is 62% impervious. McMahon’s calculation assumes approximately 98% impervious. Carl Sutter suggested that Pete put together his case with the back-up documentation and complete the appeal application. If there is an error in ERU calculation then a correction could be made. The issue relative to the credit (quality/quantity issue) is separate. Without a policy there is nothing that can be done at this time. The District deferred discussion and decision until receipt of appeal application.
ii. Hibner, for Hidden Acres Outlot – Supervisor Dexter moved to deny this appeal. Supervisor DeKeyser seconded. The motion carried: 4/0
iii. Schultz, 1945 Oakridge Road – There is no grounds for a credit for this property owner. Supervisor Winkler moved to deny the appeal. Supervisor Dexter seconded. The motion carried: 4/0
iv. N&M Transfer – This is a quantity (peak flow)/quality issue rather than a miscalculation problem. N&M has not shown that their ponds positively affect the Town’s ability to meet the DNR municipal storm water requirement. (Nothing has changed since last year.) Supervisor DeKeyser moved to deny this appeal. Supervisor Dexter seconded. The motion carried: 4/0
v. Ken Berndt – Dave Dexter moved to refund of the 2009 fee and remove the charge for 2010. Glenn Winkler seconded. The rationale is that this is a remnant parcel with no structure and is unbuildable and he is in the process of combining it with the main house parcel. The motion: 3/1, DeKeyser dissented.
c. Amend 2010 Stormwater - Dave Dexter moved to approve the amended budget. Jan DeKeyser seconded. The motion passed: 4/0
2. The meeting was adjourned at 2:40 by consensus.
