January 15, 2010 Storm Water Utility District Minutes
Town of Neenah Stormwater Utility District
Friday, January 15, 2010 at 1:00pm
1600 Breezewood Lane, Neenah
In attendance: Jan DeKeyser, Glenn Winkler, Dave Dexter, and Geoff Hibner.
Bob Schmeichel arrived at 1:25pm
The clerk called the meeting to order at 1:06pm. Glenn Winkler moved to appoint Jan DeKeyser to chair the meeting in Bob Schmeichel’s absence. Dave Dexter seconded. The motion carried: 4/0
Agenda:
1. Discussion/Action –
a. Approve minutes from November 23 meeting – Glenn Winkler moved to approve the minutes from the November 23 meeting. Dave Dexter seconded. The motion carried: 3/0. Geoff Hibner abstained as he was not at the November 23rd meeting.
b. Review the letter to the DNR regarding quarries
i. Questions/comments for Nick – Has this draft that has been approved by attorneys Gallo and St Peter? Did you make any changes after receipt of the draft from both lawyers? What/where is the revised plan?
ii. Corrections - “Pansy” is spelled wrong. Page two, three lines from bottom quality versus qualities? Page 3. Section 1. That that…delete one. Operation’s versus operations. Page 4 “rights of way” versus “right of ways”
iii. Should the letter be sent from Nick or the Town Board? Why did St. Peter believe the letter should come from McMahon rather than the Town?
c. Budget workshop –
i. The clerk will determine/propose an appropriate fee for special meetings.
ii. Separate pond (engineering versus construction) costs in the 2010 budget
iii. Determine what should be included in administration: legal/general engineering/ms4 update/bank fees/administrative
iv. Income: add grants and interest
d. Develop an appeal process for Stormwater Utility charge objections –
i. David will send the updated form to clerk. David Dexter moved to approve the form. Glenn Winkler second. The motion passed: 4/0
ii. Process for the appeal:
1. When inquiries are received the clerk will provide the appeals form.
2. Appeals will be received at a meeting to be held during the last half of January each year and at other times at discretion of Board. Person appealing does not have to appear in person.
3. The board discussed the possibility of establishing a list of reasons for which an appeal would be approved and decided that it is not possible. Each appeal will be determined on its own merits.
4. Deliberation will occur on the date of the meeting and a decision will be made, if at all possible.
5. Accepted appeals will generally be permanent, but can be revoked if circumstances change.
6. When documenting the process the meeting date created will be included for reference.
2. Old Business –
a. Ben’s email of open issues – Glenn Winkler moved to authorize Bob Schmeichel to proceed slowly working with McMahon and Winnebago County on the County O and CB pond project at minimal expense. David Dexter seconded. The motion passed: 4/0
b. Stormwater Utility Herziger land – Stewardship money to pay for the land – can the Stormwater Utility own the park? Can the Stormwater Utility lease the land to the Town for the park. Glenn Winkler moved to authorize the clerk to contact the lawyer for advice. David Dexter seconded. The motion carried: 4/0
c. January 27 meeting – It was agreed by consensus that a representative from McMahon would be unnecessary.

4. The meeting was adjourned by consensus at 3:17pm
