TOWN OF NEENAH BOARD MEETING MINUTES
April 13, 2009

In attendance: Chairman Spanbauer, Supervisors Armstrong, Dexter, DeKeyser and Winkler.
Also in attendance: Bob Schmeichel, Geoff Hibner, Harry Sturgis, Joanne Sievert, Dave Tellock, Jerry Kjemhus, Mike and Sandy Muldoon, Mike and Vicki Laux, Paul and Jennifer Pansy, Paul Sachs, Dan Dimond, Ken Kiesau, Ed King
AGENDA
1. Approval of minutes from 3/23/09 – Supervisor Armstrong moved to approve the minutes with changes noted, Supervisor Winkler seconded. Motion carried: 4/0/1 Dexter abstained
2. Open Forum – Joanne Sievert (729-9358) discussed what to do at Pleasant Acres when the pavilion is razed. Potentially move county Planning and Zoning offices to Pleasant Acres and the judicial functions to Orin King building.. First, the pavilion would come down.
3. Discussion/Action
a. Veolia recycling proposal – Dave Tellock: With regards to the recycling contract the following corrections/questions were raised: Page 2, Item 2 – renewable up to another 3 years. Page 2, Item 3 – add the word recyclables. Page 3 – item 7 remove the word rates. Page 4, Item 10 Household Unit count (Maybe collect info based on new occupancy permits). Verbiage issues. Page 5, Item 11 Veolia will take the service issues call. Page 5, Item 15 verbiage issues. Pages 6, Item 17 fill in the blanks. Supervisor DeKeyser moved for approval of the recycling contract with the changes noted. Supervisor Dexter seconded. Discussion: Does the CPI include fuel surcharge? Dave assured the Board that the CPI does not include fuel increases. Motion carried: 5/0. In addition to a recycling contract, Veolia provided a proposal for garbage/recycling to the Town at $11.98/month/household. If you add carts, the cost would increase approximately $2/household/month. Limit – 3 to 4 garbage cans per household. Large items would be charged separately.
b. Drainage issues – Laux property, 1481 Deerwood Drive. A separate concern: Jerry Kjemhus has some drainage issues. The Town put a drainage pipe in that stops at his property and floods his property. A visit by the Town Board needs to be made to the Kjemhus property. Mike Muldoon lives between Laux and Kjemhus. Supervisor Winkler and Chairman Spanbauer visited with the Auto Shop. They have one year lease left and don’t want to do anything with the property until they own it free and clear. The Auto Shop will work with the neighbors to remove the fence, re-grade the property to create a swale to capture the water. The residents were encouraged to talk with the Auto Shop owners about their water problems.
c. Approve of April Vouchers - Supervisor DeKeyser moved to approve, seconded by Supervisor Armstrong; Approved 5/0.
d. Approve permanent hiring of Diana Schmidli as Deputy Clerk/Treasurer. Supervisor Armstrong moved to approve, seconded by Supervisor DeKeyser; Approved 5/0.
e. Approve operator’s license for Nichole Van Hout, 3701 Wayman Court, Appleton, WI 54914. Delayed due to lack of application from Ms. Van Hout.
f. 2009 Plan Commission appointment – delay until April 27, 2009, meeting.
g. Approve Justin Malin as secondary user of Town of Neenah Website, Fire Department only – Supervisor Winkler moved to approve, seconded by Supervisor DeKeyser; Approved 5/0
h. Fire Department Open House – Ed King spoke for the Fire Department. The proposed date is September 26, 2009 1:00 to 4:00 or 5:00 pm. Need to coordinate date with the newsletter publication. Does the Board want to be involved? It would be nice to have the back parking lot paved in time. Safe house, demonstrations, photos. Supervisor DeKeyser moved to approve the Fire Department/Town Hall open house on September 26, seconded by Supervisor Dexter; Approved 5/0.
i. Park Board Report – Supervisor DeKeyser reported that the soccer club has decided not to renew their lease for the Mahler Park Building and will play their games at other locations. Supervisor DeKeyser would like permission to write a letter to the soccer club clarifying the Park Board and the Town Board position that the soccer club is not required to put in a sprinkler system. Supervisor DeKeyser moved to authorize Supervisor DeKeyser to write the letter, seconded by Supervisor Dexter; Approved 5/0.
j. Approve Ordinance 206 Illicit Discharge and Connections – Required by the DNR as part of the MS4 Permit Annual Report. Supervisor DeKeyser moved to approve the ordinance, seconded by Supervisor Winkler; Approved 5/0.
k. Approve Clerk attendance to Municipal Clerk & Treasurers Institute (July 12 – 17) Supervisor Winkler moved to approve the clerk attendance, Supervisor Dexter seconded. Approved 5/0.
l. Approval of hiring 4 new firefighters - Supervisor DeKeyser moved to approve, seconded by Supervisor Armstrong; Approved 5/0. Welcome letters will be written.
4. Discussion Upcoming Meetings/Events
a. Plan Commission Public Hearing, April 20

h. WMCA District Meeting, May 8 (Robin to attend for board of review training) Add Supervisor Dexter.
i. Memorial Day Parade – notification required by April 18th. Schmeichel/Winkler to participate – Spanbauer to drive.
5. Discussion Old Business
a. Supervisor Winkler and Supervisor Armstrong participated in the Recycling Annual meeting. Supervisor Armstrong put an article in the newsletter.
b. The MS4 letter was received from Coenen. Clean Water funding update presented by Supervisor DeKeyser.
c. Supervisor Armstrong asked for an update on the water testing. Chairman Spanbauer has been trying to schedule Jeff Phillips into a Town Meeting. The clerk will call and schedule Mr. Phillips for one of the meetings in June.
d. Supervisor Armstrong asked for an update on Sunset Terrace roads. There is nothing new with Sunset Terrace turning the road over to the Town.
6. New Business
a. Pansy’s need advice for 1864 Oakridge Road. Sell the nursery and the back parcel but Stanford Road doesn’t exist. What are their options? The property owner should go to the Plan Commission with a proposal/concept plan. Bob Schmeichel reviewed the procedure that must be followed. Next Plan Commission meeting is May 18th.
b. There has been legislation to reduce the obstacles for Wind Farms.
c. Resolution 2009-05 Opposing Proposed Changes to Wisconsin Prevailing Wage Law. Supervisor DeKeyser moved to approve the resolution, seconded by Supervisor Winkler. Approved 5/0.
d. Rachel Osterlang 1437 Deerwood – Schmeichel will call her.
e. Spanbauer returned the master key, two keys labeled “town”, and magnetic signs.
f. Supervisor Dexter – should the Board make a list of things that need to be voted on at the Annual Town meeting? Hourly rate, full time or part time, village powers, page 11 of green book, etc.
Supervisor Armstrong moved to adjourn, seconded by Supervisor Winkler; Approved 5/0. The meeting adjourned at 9:25 p.m.
